It's so imperative to make sure that your Property Manager is across the new legislation. Explains Shae, "These amendments mean that there are many changes to the way in which a property is to be managed. The Residential Rental Provider (RRP), previously known as a "landlord" must insure there are compliance checks carried out on all gas and electrical items, including smoke alarms. The renter, previously known as the "tenant" now has rights to make changes to the property without consent and this poses a number of challenges. However if correctly managed, these changes can be a positive experience for all parties."
1. New Rental Minimum Standards (Effective Late 2025)
Window Covering Anchors (From 1 Dec 2025): All corded internal window coverings (blinds/curtains) must have anchors installed to prevent them from forming dangerous loops.
Energy Efficiency Upgrades (Phased from 2027): While announced earlier, major standards for ceiling insulation, draughtproofing, efficient heating/cooling, and 4-star showerheads begin to apply from 1 March 2027.
Existing Standards (Still Applicable):
Heating: A fixed, energy-efficient heater in the main living area.
Electrical: Modern switchboards with circuit breakers and safety switches (RCDs).
Structural: Properties must be structurally sound and free of mould/damp related to the building structure.
Bathroom/Kitchen: Dedicated cooking areas, sink, working stove/oven, and hot/cold water supply.
Locks: Functioning deadlocks on external doors.
2. Mandatory Compliance & Safety Checks
Electrical Safety Check: Every 2 years (includes switchboards, wiring, fittings).
Gas Safety Check: Every 2 years (if the property has gas appliances/fittings).
Smoke Alarm Checks: Annual testing, battery replacement, and ensuring proper installation.
Records Management: Rental providers must keep records of these checks and provide them to the renter within 7 days of a request.
3. New Disclosure and Advertising Requirements
Advertising Restrictions (From 25 Nov 2025): It is an offence to advertise a property that does not meet the minimum standards.
Rental Bidding Ban: Rent must be advertised at a fixed price. Agents cannot solicit, encourage, or accept higher offers.
Information Privacy: Rules are stricter on how personal information is collected, stored, and destroyed, with a new standard application form coming 31 March 2026.
4. Key Dates
25 Nov 2025: No-fault evictions ban, 90-day notice periods, ban on rent bidding, and mandatory minimum standards at advertising.
1 Dec 2025: Mandatory blind cord anchors, new heating standards for rooming houses.
1 March 2027: New energy efficiency standards for insulation, cooling, and water efficiency apply to new agreements.
5. Consequences of Non-Compliance
If a property does not meet minimum standards:
Renters can request urgent repairs before moving in.
Renters can end the agreement before moving in.
